Terms and Conditions of Use — Naruto Chronicles

WHAT YOU MUST NOT DO (summary)

1. DO NOT use bots, macros, scripts, autoclickers, cavebots, auto-heal, auto-attack, auto-loot, auto-walk, trainers, hacks or any external program that automates, alters or gives an advantage in the game.
2. DO NOT use a modified, unofficial or altered client. Only the official client downloaded from the website is valid.
3. DO NOT manipulate network packets or attack the server or the website (DDoS, flood, scanning, intrusion, SQL injection, attempts to access the administration panel).
4. DO NOT exploit bugs, flaws or unintended behavior. Found one? Report it with the FEEDBACK button and do not use it. Using it even once is a violation.
5. DO NOT duplicate items, coins or experience, and do not force the delivery of Chronicles Coins without payment.
6. DO NOT sell, buy, trade, lend or transfer accounts, characters, items or Chronicles Coins for real money outside the website.
7. DO NOT share your password. The Team never asks for your password.
8. DO NOT disclose, copy or resell internal server data (formulas, tables, other players' skill values) obtained through a flaw, reverse engineering or an external tool.
9. DO NOT engage in harassment, discrimination, hate, threats, doxxing, scams, spam, explicit sexual content or advertising of other servers.
10. Violators may be banned and lose characters, items and Chronicles Coins, with no refund of donations.

1. Acceptance and who we are

1.1. These Terms govern the use of the Naruto Chronicles game server, the website https://narutochronicles.com and the official client (the "Service"). By creating an account, playing or making a donation, you declare that you have read and accept these Terms, the Donations and Refunds Policy and the Privacy Policy.

1.2. The Service is operated by the Naruto Chronicles team (the "Team", "we", "us"), from Spain. The contact address is info@narutochronicles.com.

1.3. If you do not agree with these Terms, do not create an account and do not play.

2. Nature of the Service and non-affiliation

2.1. Naruto Chronicles is a private, unofficial, fan-made server that is free to play, a 2D MMORPG set in the Naruto universe.

2.2. The Service has no relationship with, sponsorship from or approval by Masashi Kishimoto, Shueisha, Viz, TV Tokyo, Pierrot, other holders of Naruto rights, nor CipSoft or any company or official server of another game.

2.3. Names, characters, techniques and other elements of Naruto belong to their respective owners and are used here in a fan work, with no claim of official affiliation.

2.4. The technical base is free software (the Canary server, derived from OpenTibia) and our own client based on OTClient. This is only the technical origin and does not imply any connection.

3. Account and responsibility

3.1. Access is by account name and password only. When signing up you provide a main e-mail and, if you wish, a backup e-mail; they are used to link the account and to recover it or change the password safely. Each account can have several characters.

3.2. You are solely responsible for keeping your password safe and for everything that happens on your account and characters, including the conduct of third parties who use your access.

3.3. The Team never asks for your password, through any channel. Be suspicious of any such request.

3.4. You must provide truthful information when signing up and keep your e-mails up to date. Without access to the registered e-mails we may be unable to recover the account.

4. External programs, cheating and attacks

4.1. It is forbidden to use any system, program or tool external to the game that gives an advantage, automates or alters the game. The list below is only illustrative and does not exhaust the prohibition:

• bots, macros, scripts, autoclickers, keyboard and mouse recorders, "auto-heal", "auto-attack", "auto-loot", "auto-walk", "cavebot", automatic "targeting", programs that read the game's memory, DLL injectors, hooks, hacks, cheats and trainers;
• modified, altered or unofficial clients, and modifying client files to gain an advantage (removing fog, revealing the map, altering sprites to see what you should not, changing game speed);
• manipulating or intercepting network packets, proxies, "packet editors", intentional lag or disconnection, or any way of bypassing the server protocol;
• programs that read the screen and act on their own (image-based automation) and the use of multiple clients for an unfair advantage, where the server limits this;
• attacks on the server or the website: DDoS, flood, port scanning, intrusion attempts, SQL injection, exploiting flaws in the website, the shop or the panel, attempts to access the administration panel (restricted to the Team) and reverse engineering of the server to gain an advantage.

4.2. Consequence: ban of the character and/or the account, with loss of items, characters and Chronicles Coins, with no refund of donations, and possible reporting to the authorities where there is damage or a crime.

4.3. We may use automatic detection and log analysis. The Team's decision is final, subject to the appeal channel in clause 13.

5. Bugs, flaws and unintended behavior

5.1. It is forbidden to exploit bugs, flaws, design errors or unintended behavior of the server, the client or the website, for your own benefit or that of others. This includes, without limitation: duplicating items, coins or experience; forcing the delivery of coins without payment; abusing flaws in combat, jutsus, summons or clones, the map, quests, the shop, orders, payment reconciliation or transfers.

5.2. If you find a bug, report it immediately with the client's FEEDBACK button or by the contact e-mail, and do not use it.

5.3. Anyone who uses a bug, even once, or hides it or teaches it to others, may face: removal of everything obtained through it (rollback), a temporary or permanent ban and loss of Chronicles Coins.

5.4. The Team may, at its discretion, reward those who report bugs responsibly. This is a gesture of goodwill and not a right.

5.5. We may fix bugs, revert states and roll back characters or accounts at any time, without any right to compensation.

6. Accounts, characters, items and coins: sale prohibited

6.1. It is forbidden to sell, buy, trade, lend, rent or transfer accounts, characters, items or Chronicles Coins for real money or any other value outside the Service (Real Money Trading).

6.2. Sharing the account with third parties is forbidden.

6.3. Violation: ban of the accounts involved (seller and buyer) and loss of the assets, without refund.

7. Conduct

7.1. The following are forbidden: harassment, discrimination, hate speech, threats, doxxing, explicit sexual content, scams and fraud (including scamming other players), spam and advertising of other servers.

7.2. Offensive character names, or names that impersonate the Team or real people, are forbidden.

7.3. Follow the instructions of the Team (GM, ADM, God) when they moderate.

8. Internal server information

8.1. Internal data of the Service, such as characters' skills (Taijutsu, Ninjutsu, Genjutsu, Speed, Defense, Chakra Control, Seal), how to train and progress, formulas, tables and values, is confidential.

8.2. It is forbidden to expose, copy, resell or disclose such data when obtained through reverse engineering, flaws or external tools, or when it concerns other players.

9. Official client

9.1. The client may only be downloaded from the official website. It updates itself.

9.2. We may refuse old, altered or unofficial versions.

10. Chronicles Coin and donations

10.1. The Service is free and is sustained by voluntary donations. Those who donate receive, as a thank-you, Chronicles Coins, a virtual currency for use exclusively inside the game.

10.2. Chronicles Coins are not money, have no real monetary value, cannot be redeemed for money and do not create any right of ownership. You receive a limited, personal and revocable license to use them inside the game. They may be lost if you are banned for violating these Terms and cease to exist if the Service is shut down.

10.3. The rules on payment, delivery, refunds and disputes are in the Donations and Refunds Policy, which is part of these Terms.

11. Intellectual property and player content

11.1. You acquire no rights over items, characters, names, sprites, maps, texts or any other content of the Service.

11.2. Character names, messages, feedback and other content you produce in the Service grant us a free, worldwide, non-exclusive license to use them within the game and the website and to operate, moderate and promote the Service.

12. Moderation and penalties

12.1. The Team may moderate chat, warn, mute, freeze, ban temporarily or permanently, move or remove characters, items and coins, and correct errors.

12.2. The severity of the penalty depends on the violation, repetition and the damage caused. Violations of clauses 4, 5 and 6 may lead to an immediate and permanent ban, without prior notice.

12.3. Only the Team (GM, ADM, God) has access to the administration panel.

13. Appeals

13.1. Anyone who considers a penalty unjustified may appeal by e-mail to info@narutochronicles.com, within 15 days of the penalty, stating the account name, the character and the reasons.

13.2. The Team will reply within 30 days. The Team's decision after review is final.

14. Rollbacks, maintenance, wipes and shutdown

14.1. The Service is provided "as is", with no guarantee of continuous availability.

14.2. Maintenance, updates, rollbacks and partial or full wipes (resets) may occur at any time. In the event of a wipe, donations made in the previous 45 calendar days have their Chronicles Coins returned, under clause 9.3 of the Donations and Refunds Policy.

14.3. The Service may be shut down at any time. In that case there is no compensation, nor refund of donations already delivered, without prejudice to the mandatory consumer rights recognized by the applicable law.

15. Feedback

15.1. The client's FEEDBACK button is for suggestions and bug reports. By sending it, you authorize the Team to use the content freely, without payment.

16. Minors

16.1. To create an account you must be 14 years old or older, which you declare when signing up. Players under 18 play under the responsibility of their parents or guardians. Donations by anyone under 18 require authorization from a parent or legal guardian, who will be responsible for the payment.

17. Privacy

17.1. The processing of personal data is described in the Privacy Policy.

18. Limitation of liability and compensation

18.1. To the fullest extent permitted by law, the Team is not liable for loss of items, characters, progress or coins, failures, interruptions, attacks by third parties or actions of other players, nor for indirect damages or loss of profit.

18.2. Nothing in these Terms excludes liability that the law does not allow to be excluded, nor the mandatory rights of the consumer.

18.3. If you violate these Terms intentionally or negligently (for example, through attacks or cheating) and this causes the Team proven damage, you may be held liable for it, within the limits of the applicable law.

19. Changes

19.1. We may change these Terms for legitimate reasons (new features, legal changes, security or game balance). Changes will be announced on the website or in the game and, when significant, with reasonable advance notice. If you do not agree, you may stop using the Service and ask for your account to be deleted. Continuing to use the Service after the stated effective date means accepting the new version. Donations already completed remain governed by the Policy in force on the date they were made.

19.2. If any clause is invalid, the others remain valid.

20. Governing law and jurisdiction

20.1. These Terms are governed by Spanish law.

20.2. The competent courts of Spain are chosen as the forum, without prejudice to the mandatory rights of the consumer to bring proceedings in the forum that the law guarantees them.
